Modification of Base Year and Tenant’s Percentage Share. During the Extension Term, Tenant shall continue to pay Tenant’s Prorata Share of increases in Taxes and Operation Expenses in accordance with Paragraph 3 of the Lease except that the Base Year shall be modified to be the calendar year 2012.
Brokers. Tenant represents and warrants to Landlord that Tenant has not authorized or employed, or acted by implication to authorize or to employ, any other real estate broker or salesman to act for Tenant in connection with this Amendment. Tenant shall hold Landlord harmless from and indemnify and defend Landlord against any and all claims (including attorneys’ fees and costs in connection therewith) by reason of any breach of Tenant’s foregoing representation and warranty.
